1. Seller and scope
These terms apply to orders from YOUR NUTRITION GmbH, Habsburgerstrasse 10, 4310 Rheinfelden, Switzerland, email info@your-nutrition.ch.
The offer currently serves customers with a delivery address in Switzerland. Mandatory rights, particularly consumer rights, remain unaffected.
Customer terms apply only if expressly accepted by us in text form.
2. Product display and contract conclusion
Product displays are invitations to order and not binding offers unless expressly stated otherwise.
Products are placed in the cart. Before ordering, products, variants, quantities, delivery and contact details and the payment method can be reviewed and corrected in checkout.
A binding order is submitted only through the checkout button clearly identifying the payment obligation. An electronic receipt confirmation follows immediately. Unless it expressly accepts the order, the contract is concluded with our separate order or shipping confirmation, and no later than dispatch.
We may reject an order for an objective reason, including unavailability, obvious errors, failed payment, suspected misuse or an invalid delivery address. Payments already received will be refunded.
3. Language and storage
The contract may be concluded in German or English. Where wording differs, the German version is used as an interpretive reference; mandatory rights remain unaffected.
Order details and the terms in force at conclusion are stored as required by law and operations. Confirmation is sent to the email address provided.
4. Products, labelling and proper use
The product description, ingredients, nutrition values, allergens, directions, warnings and quantities shown in the store and on the delivered package apply. If an unintended difference occurs, mandatory package labelling prevails; statutory defect rights remain unaffected.
Food supplements do not replace a varied, balanced diet and healthy lifestyle. Do not exceed the stated intake and keep products out of reach of children.
Seek professional medical advice before use in case of pregnancy, breastfeeding, medical conditions, medication, intolerances or uncertainty. Product and guide content is not a diagnosis, treatment or individual medical advice.
5. Prices and shipping costs
Prices are in Swiss francs and include statutory VAT where applicable. Non-optional surcharges are included in the displayed retail price.
Shipping and voluntary add-ons are shown separately before the order. The checkout total is decisive.
We may correct obvious pricing or typing errors. Affected customers will be asked to confirm the correction or the order will be cancelled and fully refunded.
6. Availability
Availability is maintained carefully but may change before final processing. If an item becomes unavailable, we will inform the customer and refund the affected amount.
Partial delivery is made only where reasonable and without additional shipping costs. There is no right to restocking of discontinued products.
7. Payment
The current store configuration has credit or debit card payments through Stripe and PayPal active. The methods actually offered for an order are shown in checkout.
The amount is authorised or charged under the terms of the payment provider selected at checkout. An order cannot be fulfilled if payment fails or is not confirmed.
Refunds are generally made to the original method where technically possible.
8. Delivery
Delivery is made to the Swiss address entered at checkout, generally by Swiss Post. Delivery times are estimates unless expressly guaranteed.
Customers are responsible for complete, correct delivery details. Actual additional costs caused by incorrect details, refusal without justification or failure to collect may be charged where attributable to the customer.
Statutory rights apply to material delay. Force majeure or other events beyond our control reasonably extend deadlines; if the disruption becomes unreasonable, either party may cancel the unfulfilled part.
9. Retention of title
Goods remain our property until fully paid. We may register retention of title as permitted by law.
10. No voluntary withdrawal, exchange or return right
Swiss law does not provide a general withdrawal right for ordinary online purchases. YOUR NUTRITION does not grant an additional voluntary withdrawal, exchange or return right for food and food supplements.
Statutory rights for a proven defect, incorrect or incomplete delivery or transport damage remain fully unaffected. The procedure is described under Shipping & returns.
11. Inspection, defects and warranty
Please check the delivery for completeness, obvious damage and correct items. Visible issues should be reported promptly with photos and the order number. Delay does not remove mandatory rights.
Statutory warranty rights and limitation periods apply to proven defects. Where permitted, we may first choose replacement, repair, appropriate credit or refund. Further statutory rights apply if the solution fails or is unreasonable.
Ordinary minor variations, improper storage or use, natural wear and properties transparently disclosed before purchase are not defects.
12. Liability
We are liable under the law for intent and gross negligence and wherever liability cannot be excluded or limited, including injury to life or health and mandatory product liability.
For slight negligence and where permitted by law, liability is limited to foreseeable direct loss from breach of an essential contractual duty. Further liability for indirect or consequential loss and lost profit is excluded to the extent permitted.
We are not liable for consequences of use contrary to labelling, directions, warnings or professional advice where those consequences are not attributable to us.
13. Vouchers, discounts and promotions
The conditions stated for each voucher or promotion apply. Unless stated otherwise, discounts cannot be combined, paid out in cash or used outside their stated period. Mandatory rights and existing contracts remain unaffected.
14. Minors
Orders may be placed only by persons with legal capacity or with the consent of their legal representative. Product-specific age limits and warnings must always be observed.
15. Privacy
Details about website, store, payment, delivery and support data are in the Privacy policy and Cookie policy.
16. Changes to these terms
Each order is governed by the version accepted at submission. Later changes do not apply retroactively. We may update the terms for future orders, particularly for legal, technical or operational changes.
17. Severability
If a provision is wholly or partly ineffective, the other provisions remain effective and statutory rules replace the ineffective provision.
18. Governing law and jurisdiction
Swiss law applies excluding the UN Convention on Contracts for the International Sale of Goods, without removing mandatory protections.
Mandatory statutory venues apply to consumer contracts. For business customers, Rheinfelden AG is the venue where a venue agreement is legally permitted.
